If a vehicle hits and injures an animal, is it considered an accident under the Road Traffic Act?
It depends on which animal it is! The animals classified in the Road Traffic Act are: any horse, cow, ass (donkey), mule, sheep, pig, goat or dog. Therefore a road traffic accident involving a swan is not strictly speaking a road traffic accident!
If the only person injured is the driver when he brakes heavily and hits his head on the windscreen, is it a road traffic accident in the terms of the principle Road Traffic Act 1991?
No it isn’t. If there is no damage to any third party and just the driver is injured, it is not a road traffic accident in the terms of the Road Traffic Act however, if a passenger was injured and not the driver then yes it would be!
